What are the conditions of sale?

The stated value of each lot contains an estimated market value obtained from sources Buy Art Not Kids believes to be reliable, but no representation or warranty as to the actual resale value of any work is made or implied. The estimated value is intended as a guide to assist you in your bidding. All lots are being offered subject to a reserve, which is the confidential price below which the lot will not be sold.

The successful bidder's paddle number will be acknowledged by the auctioneer to confirm the sale of the lot. If your bid is successful, you will be escorted to the pay station where payment can be made. Title to the offered lot will pass to the successful bidder once full payment has been made, at which time the purchaser will assume full risk and responsibility for the lot.

If the auctioneer determines that no bids have been received that meet the minimum pre-sale reserve on any lot, the auctioneer may withdraw that lot from the sale. In the event of any disputes between bidders, missed bids, or in the event of doubt as to the validity of any bid, the auctioneer will have at his discretion the final authority to determine the successful bidder or to re-offer or withdraw the work in dispute.

If any dispute arises after the auction, the Buy Art Not Kids record of the auction proceedings shall be conclusive. All monies will be collected by Buy Art Not Kids.

What are the live auction rules?

All sales are final. No purchase can be returned, refunded or exchanged. All property is sold “as is” as exhibited. Successful bidders should be prepared to pay for their purchases by credit card on the evening of the auction. No HST or auction commission is applicable.

Buy Art Not Kids reserves the right to withdraw any work of art at any time before the actual sale.

Pick-up from the auction

All artworks must be paid for once the sale is complete. Purchasers must pick up works at the conclusion of the auction evening upon proof of payment. Buy Art Not Kids is not responsible for acts or omissions by carriers or packers of purchased lots, whether or not recommended by it. Neither Buy Art Not Kids, nor its paid agents or volunteers, shall be liable for any loss or damage to the purchased lot, whether caused by negligence or otherwise while that lot is in or under its custody or control.
